This is the official website of GetYourPardon.ca (https://getyourpardon.ca/). This particular page outlines all the Terms and Conditions unconditionally effective upon the application for using this official website and all the services available on it. By using any service of the website or the website as a whole, you (Applicant) inadvertently agree, without any qualification or limitation, to be bound by the points mentioned herein and any other alternative terms mentioned elsewhere within the website.

The applicant must be aware that we reserve the right to change, add, remove, update, or modify all information, either completely or partially, at our sole discretion. Kindly keep checking the document oftentimes to be aware of any such changes. If the applicant in any case does not agree to the Terms and Conditions mentioned here, the applicant is requested to not use the GetYourPardon.ca website.

By applying for a Record Suspension, US Entry Waiver, or Canadian Pardon on the website, the applicant agrees on the following:

Authorization

GetYourPardon.ca is authorized, upon acceptance of the application, to act on behalf of the applicant, and have the Canadian Criminal Record Pardoned, or acquire the US Entry Waiver. The company is also authorized to communicate with all the government and related organizations who, the company thinks, will aid in the process. The company is authorized to take all the necessary steps to assist the applicant in the matter and if necessary, also transfer the file to the legal counsel who would further have the authority to act on the applicant’s behalf.

Removal of Records

Once all the fines and files have been paid in full by the applicant and the eligibility fate has been met, the removal of records takes an approximate of two years to destroy or remove all the Canadian Criminal Records, depending on the crime. This timeline is subject to change according to the decision of the authorized signatory of the government. Any kind of unpaid file and fines will eventually stop or slow the process in its entirety. The Canadian National Pardon Services can only confirm the fines are outstanding, once the court documentation has been received.

The company does not have any authority when it comes to the removal of incident reports, which auto-deletes free of charge, upon being eligible for the same. This also includes certain offences that appear on a police clearance or are on the sexual offender registry. In case it is necessary, the applicant is responsible for obtaining the local police check(s) and even paying the applicable processing fees for the police and the federal government.

US Entry Waivers

Once all the fines have been paid in full by the applicant and the documents have been received, the preparation for Waiver application and the final decision of the US Customs and Border Protection takes an approximate of ten months. This is subject to change according to the sole discretion of the authorized signatory. Any unpaid fines would eventually slow or even stop the process.

The US CBP would require all the applicants to submit the US Entry Waiver application form in person and pay the fee. The application form would be inclusive of all original documentation. In case the applicant is unable to submit the waiver documents or fees within the stipulated time, the CBP is liable to charge an additional fee to update the expired documents.

General Information

As and when your file proceeds towards record removal, any balance you may owe would be charged to the applicant’s credit card details mentioned on the files. The files, however, must be paid within the first four months of when the initial payment was made. The applicant may also be asked to pay an overdue balance in case there are outstanding balances and the aforesaid fine would increase with time.

The amount paid to GetYourPardon.ca is typically used to pay various disbursements and government fees which are required to gather the documentation and information. These are also required to communicate with the various organizations involved in the procedure (government). The final decision, however, remains solely with the government. Some things you must note here are:

  • The fees of the government are subject to change without any notice.
  • Federal legislation is also subject to change without any notice. The applicant must note that there would not be any refund issued based on what the legislation changes state. However, there might be a surge fee for the changes.
  • The Federal Government, recently, has changed the word, “Pardon” with “Record Suspension” and thus the effects of the same are interchangeable.
  • The premium files are handled with care within the confines of GetYourPardon.ca office. The same does not have any control over the PBC (Parole Board of Canada), statutory eligibility dates, police, or the approval process of the American or Canadian government.
  • In case the applicant starts a file without intimating GetYourPardon.ca and it is later discovered by the company that you are not eligible for Pardon, we are liable to cancel your file without any intimation or refund, whatsoever.

The Responsibility of the Applicant

When an applicant is thinking of opting for Canadian Pardons or US Entry Waiver, he or she is responsible to:

  • Contact GetYourPardon.ca in case you change your contact details.
  • Comply with all the requests made by the company requiring any documents. If you fail to do so, your file may be destroyed and the process would have to be started again. More details about the same are written in our Privacy Policy.
  • Act with respect to all the employees working with GetYourPardon.ca. Any sort of abusive behaviour will directly affect the processing of your file and result in the cancellation without any refund.
  • Inform the company in case you are arrested or charged with a crime before the completion of your crime.
  • The company is also liable to receive the final court disposition and the new charges would also adversely affect your eligibility to receive pardons.

Involvement ofThird Party Websites

The website might contain links to other third-party websites. Such links (if any) are solely provided for convenience to you and not in any way is an endorsement by GetYourPardon.ca. The company is, in no way, responsible for the content mentioned in those websites and does not make any sort of representations related to the accuracy of the content presented therein. In case you access those, you are to do so at your own risk.

Indemnification

The applicant is to defend and indemnify GetYourPardon.ca (inclusive of all the third party websites mentioned herein) from and against any such claims and demands without limitation related to:

  • Your breach of the said terms and conditions
  • Your access to and use of the website
  • Your publication, communication, and reliance on the website or any service.

You would, therefore, use all the best efforts to cooperate with the website in the defence of such a claim. At its own expense, GetYourPardon.ca assumes the exclusive control and defence of any matter that may otherwise be subject to indemnification by you.
Any logo, service marks, or icons provided on the website are trademarks of GetYourPardon.ca. Additionally, the navigation, information, and design of the website are also under the copyright of the website.

Termination

GetYourPardon.ca reserves every right to terminate or suspend your file and accesses to the website without any intimation and limitation at any time if:

  • The credit card details are invalid
  • The company receives false information from you
  • The company does not receive due payment
  • The company decides, in its sole discretion, that you do not agree to the terms and conditions, thereby not abiding by it.
